Please read through our terms and conditions thoroughly before using our studio as a client, member or guest. As a client, member or guest of Joyful Pilates Pty Ltd 2A Kingsway Armadale 3143, you acknowledge that you have read and agreed to these terms and conditions as laid out on our website: .
When joining Joyful Pilates for the first time as a client, member or guest, you will be required to tick the ‘accept’ box to formally acknowledge our Terms and Conditions, and understand that in doing so, you are entering into a binding agreement with Joyful Pilates. These Terms and Conditions apply to all users of our studio. We reserve the right to restrict a client, member or guest from using our facilities, and in particular circumstances, we may terminate access and permission to use our studio, such as breaching these Terms and Conditions.
ACCESS TO JOYFUL PILATES:
You must be at least 18 years old to participate in our Pilates Classes unaccompanied.
For clients who are over 16 years and under 18 years, a signed consent form must be provided from a parent or legal guardian prior to participating in our Pilates Classes unaccompanied. Clients under 16 years of age can attend when accompanied with a parent or legal guardian.
It is recommended that if you are under 18 years of age, you seek medical advice prior to participating in our classes to ensure our classes are appropriate for you.
You must ensure you are wearing suitable attire for your classes, and that no glass water bottles are taken into the studio itself. Shoes must be removed before class and socks must be worn.
Any belongings you leave behind will be held in lost property on our premises for a maximum of 1 week, after which time they will be donated to charity.
USE OF JOYFUL PILATES FACILITIES AND EQUIPMENT
It is your responsibility to use our equipment and facilities with respect and care. If you are unsure of how to use anything, please ask for assistance.
It is our right to remove or replace any equipment.
We reserve the right to close our studio for holiday periods. If we choose to close our studio for more than 4 consecutive days, you may request an extension on your membership or class packs without penalty.
Lockers are provided for you at our studio, and you agree that any personal belongings and valuables left in the lockers are your sole responsibility.
Joyful Pilates will not be held responsible or liable to you, should any of your personal belongings and valuables become lost, stolen or damaged at our studio. We strongly recommend all valuable possessions remain with you at all times and are not left unattended at our premises.
Lockers are not to be used to store personal belongings when you are not in the studio. Any lockers that are left locked over night will have all belongings removed.
OUR RIGHTS
When joining our classes, you agree that you are voluntarily participating with full knowledge that there may be risk of personal injury, property loss or death. You accept that while our instructors may provide you advice and support should you have a medical condition, you acknowledge our instructors are not medical practitioners, therefore you are solely responsible for your health and your ability to participate in our classes.
It is your responsibility to:
ensure that you have permission from your doctor or treating practitioner to participate in our classes; Advise our instructors if you have any medical or physical conditions that may affect your participation in our classes; Advise our instructors if a medical or physical condition changes after making a booking; and follow all instructions provided to you by our qualified instructors. You acknowledge that any failure to do so will be at your own risk and may cause injury.
We are in no way liable for any personal Injury or death resulting from your participation in our classes. This does not apply if your death or personal Injury is due to our Gross Negligence.
BEHAVIOUR
We require that at all times while using our Services, you:
are respectful towards other members, guests, our staff and outside providers;
do not engage in verbal or physical intimidation, harassment or discrimination.
PRIVACY
Joyful Pilates will:
ensure that our Privacy Policy is accessible on the Website, and that the Privacy Policy complies with the Privacy Law;
comply with the provisions of the Privacy Policy, particularly in relation to the collection, retention, and usage of data;
comply generally with the provisions of the Privacy Law; and
provide any reasonable assistance required by you in relation to any disclosure required by law.
LAW AND JURISDICTION
These Terms will be governed by and construed according to the law of Victoria, Australia, and any dispute arising out of or in connection with these Terms must be determined in the courts of the State of Victoria, Australia and/or in the Federal Court of Australia sitting in Victoria.
MEMBERSHIPS, BOOKINGS AND PAYMENTS
PRICING AND PAYMENT
Unless otherwise provided in these Terms:
All prices are quoted in Australian Dollars ($AUD) and all transactions are processed in Australian Dollars ($AUD).
Prices, products and offers include GST. All prices are correct at the time of online publication.
Prices are subject to change without notice. All offerings are promoted in good faith to be available at the time of booking.
Promotions are only available at the advertised price during the promotional period.
JOYFUL Pilates does not offer refunds, transfers, suspensions or extensions on Services purchased at JOYFUL Pilates for change of mind.
JOYFUL Pilates reserves the right to pass on the cost of any additional bank fees which may incur from disputed or failed transactions regarding a guest transaction.
Payment must be made upon booking.
PRE AND POST NATAL POLICY
We acknowledge there are wonderful benefits for mums-to-be when engaging in a well structured exercise program. However, if you are new to Joyful Pilates, we do request that you gain medical clearance to attend our classes during your pregnancy. Medical clearance can be sent to us via email hello@joyfulpilates.com.au
If you have been attending our classes and you are NOT a high-risk pregnancy, you may continue group classes throughout your pregnancy. We kindly request you inform your instructor what week of pregnancy you are up to each week, to ensure recommended modifications of certain exercises are provided to you. It is your responsibility to take the necessary precautions with how you are feeling during the session and we strongly encourage you to pull back and take it easy if you are experiencing any discomfort.
Post-natal:
We are so excited to welcome you back and wish to ensure you introduce our sessions back into your routine slowly and with caution. We kindly ask you consult with your Obstetrician or GP after your 6-8 week check-up, to ensure your recovery and physical health is cleared for our classes.
Bookings, Attendance & Cancellations
- A minimum of two people are required for a class to proceed. If you have booked a class with less than two people confirmed, you will be contacted via text, phone or email up to 2 hours prior to the start of class time, communicating the cancellation of the class. Your session will be returned to your account for future use.
- Our cancellation policy is in place to ensure all our guests are afforded the opportunity to attend our classes. Cancellations made within our 9-hour cancellation window, will be deducted from your account or class pack. No-shows and absences will forfeit that session and a fee may be charged.
- Payment must be made prior to booking and attending a class. To book into a class you must either have pre-purchased sessions in your MindBody account, hold a valid membership or have paid at the time of booking in the studio.
- Out of courtesy for the teacher and other clients, please don’t be late. If you are more than 2 minutes late for a class, your spot may be given to a waitlisted or stand-by client and you may be refused entry to attend the session. Our Joyful trainers plan their classes with a warmup to ensure each session is safe for all clients. Our trainers reserve the right to turn you away if you are late for their class and they feel it would be unsafe for you to attend.
- Our Joyful trainers reserve the right to restrict clients to a particular class type for safety reasons; and reserve the right to turn clients away if they do not have the correct medical clearance for their booked session.
WAITLISTS:
1. If a class is fully booked, you can join the waitlist. Should a place become available you will receive either an email or text from us, offering you a place in the class. You can respond with a Yes or a No. If you fail to respond, we will assume you are a Yes, and a session will automatically be deducted from your account. If you cannot attend, please ensure you communicate No, so that your place may be offered to the next client on the list.
CLASS PACKS AND OTHER PURCHASES:
1. Annual block class packs are valid for 12 months from purchase date. Sessions are non-refundable and are not transferable. Block class packs can be extended for medical reasons, however, a medical certificate is required to grant this extension. Extensions due to medical reasons must be requested before the expiry date.
2. Monthly class packs are valid for 30 days from the date of your first class booking. Sessions are non-refundable and are non-transferable. Monthly class packs can be extended for medical reasons, however, a medical certificate is required to grant this extension. Extensions due to medical reasons must be requested before the expiry date.
3. Sessions are non-transferable to another individual and cannot be used by another person. If someone, other than the person booked into the class, arrives to use the session, they will be asked to create an account and purchase their own sessions.
4. Joyful Pilates Gift cards can be used for classes, packs and products at Joyful Pilates. They are not redeemable for cash and are non-transferable. We do not offer refunds, transfers, suspensions or extensions on Gift Cards for change of mind, injury, illness, change of address or any other reason.
All purchases are final and in accordance with the Australian Competition and Consumer Commission.
INTRO OFFER:
1. Our Introductory Offer is only available to brand new clients of Joyful Pilates and can only be purchased once per client. The introductory offer is non-refundable nor transferable and will activate from the date of your first class booking. Intro offer classes expire after 14 days from date of first booking.

Joyful Pilates Foundation Memberships
Joyful Pilates Foundation Memberships Includes:
- Unlimited Weekly Foundation Membership
- Unlimited 6-monthly upfront Foundation Membership
- Unlimited 12-monthly upfront Foundation Membership
Foundation Memberships purchased during a studio membership promotion are subject to the following terms and conditions:
- Foundation Membership prices are valid for the duration of a continuous membership. Continuous membership means an ongoing weekly payment, or 6-monthly / 12-monthly renewal is made to retain the membership without breaks, unless a membership suspension is requested and approved by the Joyful Pilates team (see Membership Suspension T&Cs section for details).
- If a Foundation Member cancels their membership and wishes to sign up for membership again at a later date, they will no longer be eligible for the Foundation Membership promotional rate. A new rate will apply, which is the regular membership rate.

Joyful Pilates Weekly Memberships
Joyful Pilates Memberships Includes:
- 2 Classes p/Week Membership
- 3 Classes p/Week Membership
- Unlimited Weekly Membership
- All Joyful Pilates memberships operate on a fortnightly (14-day) autopay schedule from the credit card or bank account stored in Mindbody (a secure system).
- Memberships will continue with scheduled autopays unless Joyful Pilates is notified of a termination request in writing (see our Termination Policy below).
- Memberships may be subject to price changes and you will be notified of one in writing 4 weeks prior to any change.
- Classes p/week membership allowance of sessions do not roll over from week to week.
- New Memberships are subject to a minimum six week lock-in contract after which, cancellation can be arranged anytime in writing (see Termination Policy below). Memberships are able to be updated/downgraded within the 6 week minimum contract.
- Unlimited Memberships will incur a $15 No Show fee for any classes they’re marked absent for and a $5 Late Cancel fee for all classes cancelled within 9 hours of class. A Late Cancel 30 minutes before class is considered a No Show. All Members will receive 1 fee waiver per calendar month.
- If you hold a 2 Class and 3 Class p/Week Membership, you are welcome to join the number of classes per your membership, in any given week. We do not have a standard ‘week’, as it will depend on your individual preferences. Your ‘week’ begins on the day of your billing cycle. For example, if you pay on a Wednesday, you can attend two classes between Wednesday and the following Tuesday. Please note that any unused classes do not roll over to the next week.
- 2 Class and 3 Class p/Week Memberships can purchase additional sessions at $22 per class. This is the responsibility of the member to arrange prior to taking class via purchasing individual sessions. Additional sessions will be valid for 7 days from purchase. If during the weekly cycle, an extra session is taken and shows as unpaid or owing, $22 will automatically be charged to the card/bank details on file per session booked, regardless of late cancel or no show.
- Failed Membership payments will incur a $10 fee for every day the payment fails to process. This fee will be processed as a debit on the clients MindBody account which will be processed with the Membership payment.
- It is your responsibility to ensure there are sufficient funds available to cover the fortnightly (14 day) auto pay. If an auto pay debit cannot be made for any reason, Joyful Pilates may in its absolute discretion, reprocess the missed payment anytime after the due date upon receipt of sufficient monies in your account.
- As part of the membership agreement, Joyful Pilates reserves the right to refuse entry to classes or cancel bookings if a client account is in arrears and until they bring their account up to date.
- On the third attempt of payment failing to process all booked classes will be cancelled and the Membership will be placed on hold. The failed Membership charge, plus any outstanding fees will be processed as a debit on the clients MindBody account, to be balanced within 7 days or the account will be terminated.
- No refunds or transfers are offered on unused portions of memberships due to illness, injury, change of address or any other reason unless otherwise agreed by Joyful Pilates. (see our Termination Policy below)
- Memberships are non-transferable and must not be sold, traded, gifted, shared, provided or otherwise transferred to any other person. If we discover that you are engaging in any of these activities, we reserve the right to cancel your Membership permanently.
Membership Suspensions
- At least 2 week’s written notice is required for membership suspensions/holds. This ensures that the correct measures are put in place to cease credit card payments that are scheduled for the given period.
- Suspensions can be processed for a minimum of 7 days (1 week) and a maximum of 56 days (8 weeks).
- Upfront memberships are not eligible for suspensions for any reason.

Membership Termination Policy
- Joyful Pilates requires at least 2 week’s written notice to terminate membership. Please email request to hello@joyfulpilates.com.au
- New Memberships are subject to a minimum six week lock-in contract after which termination can be arranged anytime in writing via email to hello@joyfulpilates.com.au.
- In the case of long term or permanent injury or illness that prevents the use of our services, immediate membership termination will be permitted. Termination will take effect from the date we receive written confirmation from a medical doctor.
- Joyful Pilates may terminate a membership without notice for inappropriate, offensive or illegal behaviour, as determined by us, which occurs on our premises or is directed at our staff or other members.
